Description
The Nebraska Department of Motor Vehicles has an Attorney II position open.

The attorney in this position will serve as an Administrative Hearing Officer, draft and promulgate rules and regulations, serve as the staff attorney to the Motor Carrier Services and Driver Licensing Services Divisions, perform duties assigned by Agency Legal Counsel.

Salary Range $28.185 - 39.569, if approved

8am - 5pm, Monday - Friday
Examples of Work
Serve as an Administrative Hearing Officer to conduct Administrative License Revocation (ALR) hearings and all contested hearings before the agency. Draft proposed findings of fact, conclusions of law, and recommended orders for the Director. Legal support and enforcement staff attorney for the Motor Carrier Services Division for tax evasion. Review, support, and advise on enforcement of tax evasion collection. Provide legal support to the Driver Licensing Services Division on all commercial driver license issues. Review all federal laws and maintain compliance with all federal requirements. Correspondence and answering legal calls and inquiries from the public, attorneys, law enforcement, and other governmental entities. Knowledge of all agency statutes, rules and regulations, policies and procedures that pertain to possible inquiries. Draft and promulgate agency rules and regulations as required by the Administrative Procedure Act. Projects and correspondence as assigned by Agency Legal Counsel. Assist Agency Legal Counsel with the review and response to public records requests. Confer with the Director, Agency Legal Counsel, Staff Attorneys, and Agency Administrators on the facts and status of issues, cases, and other legal/administrative actions that impact the agency. Research federal rules and recent court decisions for agency impact. Analyze legal issues and prepare agency documents to help guide agency policies and practices. Counsel legal staff on issuance of discovery, subpoenas, and preparation for hearings. Analyze appeals and miscellaneous petitions before the agency. Prepare and conduct training of law enforcement officers on the ALR process. Limited travel in Nebraska required for training.
Qualifications / Requirements
REQUIREMENTS: One year of experience as an attorney practicing law and providing legal services such as preparing cases, advising clients, and/or interpreting laws or administrative policies. Must be admitted to the Nebraska Bar. Please attach a writing sample with your application.

PREFERRED: Knowledge of motor vehicle laws, tax enforcement laws, administrative hearings and procedures, and rule and regulation promulgation.

OTHER: Valid driver's license.
Knowledge, Skills and Abilities
Knowledge of: the techniques of preparing/drafting legal documents and forms; the principles and practices of criminal and civil law administration; judicial procedures and rules of evidence; the principles and practices of legal research; the procedures of trial and administrative hearings.
Skill in: preparing summaries, legal analyses, findings, conclusions, briefs, and other legal documents; negotiating and communicating with others sufficient to persuade their acceptance of contentious goals or viewpoints.
Ability to: prepare and communicate in person and by telephone, emails, summaries, and correspondence, the facts and arguments of a case to persuade others to accept the viewpoint presented; interact with legal associates, other government employees, the public, and representatives of parties involved in a case; formulate legal opinions and recommendations based on legal research and investigations; conduct legal research and investigations; prepare drafts of legal documents and forms; identify critical elements of legal questions or issues and select appropriate course of action; interpret and apply statutes, case law, decisions of judicial and administrative hearings, and administrative rules and policies.
